Personal Information Protection Policy

Dutailier Group Inc. (the “Company” or “we”) attaches great importance to the protection of personal information, that is, any information concerning a natural person that allows, either taken alone or in combination with other available information, to identify him or her.

The purpose of this document is to inform you about how we collect, use, disclose, retain or otherwise treat personal information in the course of our business activities, including the provision of our products and services (collectively, the “Services”), including the operation of the www.dutailier.com website (the “Site”).

By accessing, subscribing to or using our Services or the Site, you consent to the collection, use, disclosure and processing of your personal information by the Company in accordance with this policy (the “Policy”).

If you do not agree to these terms, please do not use our Services or access our Site.

The Company collects, uses or discloses personal information with the consent of the individuals concerned, except where permitted or required by law.

You may change or withdraw your consent at any time, subject to applicable legal restrictions and contractual terms, and reasonable notice by contacting us. If you choose not to provide us with certain information that is necessary to provide you with our Services, the Company may no longer be able to provide or continue to provide some of our Services, as the case may be.

    • In order to process and enable the processing of orders and to ensure the delivery of the Services;

    Wherever possible, this information is collected directly from the individual concerned. The Company may also collect and use information about an individual from a third party where permitted by law, and with the consent of the individual in all other cases.

    If you voluntarily provide us with personal information, either by e-mail or by filling out a form, we will use only the information required to enable us to respond to your message or follow up on your request.

    What Information Do We Collect?

    Use of Cookies and Automatically Exchanged Information

    Our Site does not place any permanent cookies on the hard drives of visitors’ computers, but only a temporary cookie required to improve the performance of certain features of the Site. 

    In addition, your computer and the Site’s server automatically exchange certain information when you access the Site. This is necessary for the server to transmit a file compatible with the computer equipment you are using. The information exchanged may include the following in particular: 

    • the domain name of your Internet service provider;
    • your IP address (unique number assigned to your computer when it is connected to the Internet);
    • the type of browser (Explorer, Safari, Firefox, etc.) and operating system (Windows, Mac OS, etc.) you use to access the Site;

    • the address of the referring Site, if you access the Site from another site.

     This information is kept and used by the Company for technical and statistical purposes, in particular to count the number of visits, the most frequently visited pages, the technology used by visitors, the referring sites and the geographical origin of visits.

    You can configure your browser to prevent cookies from being saved. Most browsers provide instructions on how to disable them in the “Help” section of the toolbar. Please note, however, that if you disable our cookies, some functions and features of the Site may not function properly.

    Who Can Access Your Personal Information

    The Company does not disclose personal information for purposes other than those for which it was collected, except with the consent of the individual or as required or permitted by law, and limits disclosure and access to personal information to only those individuals who need it for those purposes.

    Within the Company, access to personal information is limited to employees who need the information to perform their duties. In addition, the Company will only disclose personal information to third parties for the purposes identified or implied in this Policy or at the time of collection, with your express consent or otherwise when required or permitted by law.

    In particular, the Company may share personal information with trusted partners or suppliers who act as subcontractors for the following purposes:

    • To subsidiaries, representatives or subcontractors, to satisfy an order or to outsource one or more of the Services offered by the Company, or to provide customer service;
    • To online payment service providers, to process transactions made on the Site;
    • To computer and data hosting service providers, to enable the Company to use, analyze, store, secure or otherwise process information in its custody or control in accordance with this Policy, or to administer this Site;
    • To providers of physical or electronic mail services, to deliver or send e-mail or postal mail to communicate with you;
    • To outside consultants to analyze our Services and the Site with respect to the needs of our customers in order to improve our Services or the Site or to create new ones;
    • As part of a business transaction, if necessary to make a decision to proceed with the transaction and in accordance with applicable legal requirements; and
    • To fulfill any purpose identified in this Policy and any other purpose that the Company will identify, no later than the time the information is collected.

    The Company will ensure that all third parties with whom it does business and to whom it provides personal or confidential information, will also guarantee to the Company, in at least an equivalent manner, the confidentiality, security and integrity of the information they possess on behalf of the Company.

    Please also note that personal information collected by the Company may be routed through servers outside of Canada and may be transmitted to and stored at a destination outside of Canada. This information may also be processed by persons located outside of Canada who work for the Company, its partners or suppliers. When personal information is outsourced to a company in another country, the information may be made available to the government of that country or its agencies pursuant to a lawful order made in that country.

    How Do We Protect Your Personal Information?

    The Company undertakes to apply and require its subcontractors to apply physical, technological and administrative security measures in order to maintain the confidentiality, integrity and availability of the personal information for which the Company is responsible, in order to protect it against loss or theft and any unauthorized consultation, copying, use or modification.

    The level of protection afforded to personal information is dependent upon the sensitivity of the personal information, the amount, distribution and format of the information and the method of retention.

    In addition, we use contractual and other means to ensure that third parties provide a similar level of protection to the personal information they process.

    Notwithstanding the foregoing, no method of transmitting or storing electronic data is infallible. The Company cannot guarantee the security of the information transmitted or stored through the Services and therefore cannot guarantee that the confidentiality, integrity and availability of the data will not be compromised.

    User Account and Access IDs

    Please note that you are responsible for maintaining the confidentiality and security of the information used to log into your user account, if any (the “Access IDs”). It is strongly recommended that the user choose a strong password that no one can guess and that is not used on other websites. Any access to or use of an account, including for the purchase of Services, made with Access IDs will be deemed to have been made by the actual account holder associated with the account. The Company may follow up and act in accordance with any communication made or instructions given with the use of the Access IDs.

    Retention of Personal Information

    The Company retains personal information for as long as it is reasonably required for the purposes for which it was collected, to comply with the law or to protect its rights. Thereafter, the information is anonymized or securely destroyed.

    In the event that a user of the Site deletes his or her account, the Company will retain the information contained therein for as long as required for legal, accounting or tax purposes, to assist in any investigation and to enforce this Policy and the Site Terms of Use.

    Access, Correction and Updating of Personal Information

    The Company makes reasonable efforts to ensure that personal information is as accurate and complete as is necessary for the purposes for which it is to be used.

    You have the right to access, correct or update your personal information. You may do so, among other things, by modifying your user account profile or by contacting us. The Company will respond to any written request within 30 days. The Company may deny such a request in circumstances permitted by law, in which case the Company will provide you with written reasons for denying the request.

    Links to Other Sites

    Our Site may contain hyperlinks to other sites. These other sites are not under our control and we are not responsible for the manner in which these sites treat personal information. The information exchanged on these sites is not subject to this Policy, but to that of the external site, if any. We strongly recommend that you review the privacy policies and terms of use of these sites.

    Modifications

    The Company reserves the right to modify this Policy. In the event that the Company modifies this Policy, any change will be brought to the attention of the users of the Site and customers before taking effect, whether by a mention when accessing the user account, by means of a banner on the Site or by any other means. The effective date of this version of the Policy is indicated at the beginning of the Policy. It is recommended that you consult this Policy on a regular basis to review the Company’s current practices. By continuing to provide your personal information, obtain our Company’s Services, or use this Site, you consent to the Policy in its version then in force. If you disagree with any changes to the Policy, you must immediately stop accessing or using the Services or the Site and delete your user account.
